Significant Amendment to the Turkish Civil Code Regarding Divorce Procedures: Article 166/4 Updated

A significant change has been made to Article 166, Paragraph 4, of the Turkish Civil Code (Law No. 4721), shortening the time period in divorce cases.

According to the new amendment, if a divorce case filed for any reason is dismissed and the spouses have lived separately for 1 year from the date the dismissal becomes final, and if the marital life has not been restored, the marriage will be considered irretrievably broken. In this case, one spouse can file for divorce, and a divorce will be granted upon their request.


Before this change, the required period of separation for granting a divorce under the same conditions was 3 years. However, with the new regulation, this period has been reduced to 1 year.


This amendment is expected to expedite divorce proceedings, allowing individuals to make a fresh start more quickly in cases where the marriage has effectively ended.
